·       The distance between the low rail and the high rail must be at most 90 cm;
·       The distance between the concrete support and the low rail must be at most 11 cm;

Railing with horizontal rungs

Who is responsible for changing or maintaining guardrails?
To answer this query, it is necessary to determine if the guardrail is a privative part or a shared part, what the regulation of co-ownership must in principle stipulate.
Generally, guardrail gate are private. Their maintenance and their change are therefore up to each co-owner. The co-owner who wishes to replace a guardrail on the facade must first obtain the agreement of the syndicate of co-owners by a vote in general assembly, because this change involves a modification of the exterior appearance of the building.

Guardrail Gate

Sometimes the guardrails and balconies, on which they are placed, are considered common areas with private enjoyment.

The change of all the guardrails of the co-ownership can then be voted in general assembly as part of a facelift or building improvement work. In this case, the expenses incurred concern all the co-owners, who will participate to the extent of their share. Depending on the case, they may be considered as general expenses or special charges. They will then be divided according to the royalties held by the co-owners, biased with a coefficient of utility in the second case.
